1. Introduction and Acceptance

These Terms of Use constitute a legally binding agreement between you and the developer of iBlood ("we", "us", "our"), which informs you about your rights and our rights regarding your use of our mobile application, iBlood ("the app").

Please read these terms very carefully. By downloading, accessing, or using iBlood, you signify that you have read, understood, and agreed to be bound by these terms. If you do not agree to all of these terms, you are not authorized to use the app.

2. Updates and Modifications

We reserve the right to modify these terms from time to time. If we make any substantial changes, we will update the text within or in connection with the app, and such modifications shall be effective at the moment of the update. Your continuous use of iBlood after changes are posted shall be deemed as your explicit agreement to the modifications.

Additionally, we may automatically update iBlood frequently to improve performance, enhance functionality, reflect changes to the operating system, or address security issues. If you choose not to install such updates or if you opt out of automatic updates, you may not be able to continue using the app properly.

3. Restrictions

Unless expressly permitted in these Terms, you must not:

(a) copy our app except as part of your normal use or as necessary to create backups for personal security purposes;

(b) modify, translate, adapt, or merge all or part of our app with any other program;

(c) reverse engineer, disassemble, decompile, or reduce the object code of our app to source code form;

(d) distribute, sub-license, assign, share, sell, rent, lease, or otherwise transfer our app or your right to use it;

(e) remove, modify, block, or obscure any copyright, trademark, or other proprietary notices belonging to us within the app;

(f) extract any data or metadata from our app nor create any index or database incorporating any part of it;

(h) carry out any harmful, malicious, or illegal activities using our app.

Breach of these restrictions will entitle us to hold you liable for any losses, including legal fees, incurred as a result.

4. Intellectual Property

We retain exclusive worldwide property rights, copyrights, and trademarks in iBlood, its original content, design, and related documentation. Our intellectual property rights may not be used in connection with any product or service without our prior written consent. Any unauthorized sale, copy, reproduction, or creation of derivative works of iBlood is strictly prohibited.

5. Links to Third Parties

You acknowledge that iBlood may contain hyperlinks to third-party websites or resources, such as Apple's privacy pages or external support links. We do not control such external websites and are not responsible for their contents, terms, or privacy practices. Your use of third-party sites is entirely at your own risk.

6. Payment and Subscription Terms

iBlood may offer premium paid services or auto-renewable subscription plans, such as Weekly and Yearly. The specific pricing and payment structures are clearly displayed inside the app.

Auto-Renewal: Subscriptions automatically renew at the end of the current billing period unless canceled at least 24 hours prior to the renewal date.

Management: You can manage your subscriptions and turn off auto-renewal at any time through your Apple ID Account Settings.

No Refunds: If you cancel a subscription purchased via the Apple App Store, you will not receive a refund for the current billing period, but you will retain premium access until the remainder of the current billing period expires.

Platform Limitation: Subscriptions cannot be transferred between different operating systems. These purchases are exclusively valid and usable on iOS devices via your Apple ID.

7. Termination

These Terms apply from the date you download the app and will remain in full force and effect while you use iBlood. We may terminate or suspend your right to use the app immediately, without prior notice, if you breach this agreement.

You can terminate these terms at any time by ceasing to use iBlood and permanently deleting or uninstalling it from your device. Upon termination, sections 4, 6, 7, 8, and 10 shall continue to apply.

8. Limitation of Liability

To the maximum extent permitted by applicable law, our aggregate liability for direct damages arising out of or in connection with these terms shall be limited to 100% of the fees actually paid by you to us for the app during the calendar year in which the event occurred.

OUR APP IS FOR DOMESTIC AND PRIVATE USE ONLY. IF YOU USE OUR APP FOR ANY COMMERCIAL, BUSINESS, OR RESALE PURPOSE, WE WILL HAVE NO LIABILITY TO YOU FOR ANY LOSS OF PROFIT, LOSS OF BUSINESS, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS OPPORTUNITY.

9. Privacy Policy

Your privacy is highly important to us. Alongside these terms, we have published a Privacy Policy detailing how the app functions entirely offline without a backend. Although the Privacy Policy is a separate document, we strongly encourage you to read it to understand how local data storage operates on your device.

10. Disclaimers and Medical Warranties

THE SERVICES AND SOFTWARE ARE PROVIDED "AS-IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE APP WILL BE CONSTANTLY AVAILABLE, UNINTERRUPTED, SECURE, OR COMPLETELY ERROR-FREE.

CRITICAL MEDICAL DISCLAIMER:

iBlood DOES NOT MEASURE OR CHECK YOUR VITAL SIGNS. iBlood is exclusively a digital logging tool designed for manual record-keeping of your blood glucose, blood pressure, heart rate, and blood oxygen trends. It does not provide medical advice, diagnosis, or treatment.

The content and charts generated within the app are for informational and self-tracking purposes only and must not be used as a substitute for professional medical guidance. Always seek the advice of a qualified healthcare professional or physician regarding any medical conditions. Never disregard professional medical advice or delay seeking it because of information tracked or read within this app. Use iBlood responsibly and at your own risk.

11. Governing Law and Disputes

If any provision of these terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision will not affect the validity of the remaining provisions, which remain in full force.

All disputes arising out of or in relation to these Terms shall first be attempted to be settled amicably through mutual discussion. If a mutual agreement cannot be reached, the dispute shall be resolved through the courts holding jurisdiction over the defendant's domicile.
